1. Introduction

Welcome to The Prop Factory (“we,” “us,” or “our”). By accessing or using our website and services, you agree to comply with and be bound by these terms and conditions (“Terms”). If you do not agree with these Terms, please refrain from using our website and services.

Our services include prop hire and event styling for various events, including but not limited to weddings, corporate functions, and private parties. These Terms govern your use of our website and the provision of our services.

2. Eligibility

• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.
• The information you provide to us is accurate and complete.

3. Booking and Payment

3.1 Booking Process

• Bookings can be made via our website, email, or phone.
• All bookings are subject to availability and confirmation by us.

3.2 Payment Terms

• A non-refundable retainer of $100 is required to secure your booking.
• Full payment is due 2 weeks before the event date unless otherwise agreed.

3.3 Cancellations and Refunds

• Cancellations made more than 4 weeks before the event will receive a refund minus the deposit.
• Cancellations made within 4 weeks of the event are non-refundable.

4. Use of Hired Props

4.1 Responsibility

• You are responsible for the care and safe return of all hired props.
• Any damage, loss, or theft will be charged to you at the repair or replacement cost DAMAGE AND REPLACEMENT COSTS
  • Light up letter (1.2m) re-powder coating due to scratched paint - $400 + GST
  • Light up letter (1.2m) replacement (including bent or misshapen metal that cannot be repaired) - $1800 + GST
  • Light up letter (60cm) replacement - $900 + GST
  • Base plates & pole set for shimmer walls and flower walls replacement - $1100 + GST
  • Flower garland replacement (including due to stains or discolouration) - $700 + GST
  • LED bulb replacement - $50 + GST
  • LED bulb remote replacement - $30 + GST
  • LED neon remote replacement - $30 + GST
  • RGB neon sign replacement - From $400 + GST depending on the size of the sign
  • Other miscellaneous hire items and accessories (including but not limited to stands, power boxes, extension cables, wooden arches) - Market rate + GST.

  4.2 Usage Guidelines

  • Props must be used only for their intended purpose and as per our instructions.
  • Props must not be altered, painted, or modified without prior approval.

  5. Styling Services

  5.1 Scope of Services

  • Our styling services include consultation, design, setup, and pack-down as agreed in your booking.

  5.2 Changes to Styling Plans

  • Any changes to the agreed styling plan must be requested in writing and may incur additional charges.

  6. Website Use

  6.1 Intellectual Property

  • All content on our website, including images, text, logos, and designs, is our intellectual property. You may not reproduce, distribute, or use our content without our written permission.

  6.2 Prohibited Activities

  • You agree not to engage in any activities that may harm our website or disrupt its functionality.
  • You must not use our website for illegal or unauthorized purposes.

  7. Limitation of Liability

  • We are not liable for any indirect, incidental, or consequential damages arising from the use of our services or website.
  • Our total liability to you shall not exceed the total amount paid for the booking.

  8. Indemnity

  You agree to indemnify us against any claims, damages, or expenses arising from your breach of these Terms or misuse of our services.

  9. Privacy

  10. Governing Law

  These Terms are governed by the laws of Australia. Any disputes will be resolved in the jurisdiction of Victoria.

  We reserve the right to update these Terms at any time. Changes will take effect immediately upon posting on our website. Your continued use of our website and services constitutes acceptance of the updated Terms.
